Right to Privacy
In many states, employees have a right to privacy in the
workplace. These rights vary in degree from state to state. Depending on the
state and whether the employee is in the public or private sector, this right
may apply to the following:
- The employee's personal possessions, including handbags
or briefcases, storage lockers accessible only by the employee, and private
mail addressed only to employee.
- Telephone conversations or voicemail messages. However,
the right to privacy may be qualified by policy and is even more limited
as it relates to e-mail messages and Internet usage while using an employer's
computer system.
- An employer may not conduct a credit or background check
of an employee or prospective employee unless the employer notifies the individual
in writing and receives permission to do so.
